Terms of Use

Last updated: 31 October 2026

Welcome to NOTS Market ("NOTS", "we", "us" or "our"). NOTS is an online marketplace where people can discover, list and connect over vintage, antique and second-hand items.

These Terms of Use explain the rules for using NOTS. By creating an account or using the website, you agree to these terms.

1. About NOTS Market

NOTS Market is currently operated by an individual and is not a registered company.

Operator: [YOUR FULL LEGAL NAME], trading as NOTS Market.

Contact email: liamd1748@gmail.com

NOTS provides an online platform where users can browse listings, create seller profiles, advertise items and contact other users.

NOTS is not currently a shop or retailer and does not directly sell the items advertised by users.

2. Age requirements

You must be at least 18 years old to create an account or use NOTS as a registered buyer or seller.

By registering, you confirm that you are 18 or older and that the information you provide is accurate.

We reserve the right to suspend or close accounts where we reasonably believe the age requirement has not been met.

3. Creating an account

When creating an account, you agree to:

You are responsible for activity carried out through your account, except where the law provides otherwise.

4. How the marketplace works

NOTS allows sellers to advertise items and buyers to contact sellers directly.

At launch:

Any agreement to buy or sell an item is made directly between the buyer and seller, not with NOTS.

We may introduce additional features or services in the future. If we do, we will provide any relevant updated terms before those features are introduced.

5. Seller responsibilities

If you advertise an item on NOTS, you agree that:

You must not advertise an item that you do not have the right to sell.

If you sell as a business or trader, you are responsible for complying with the consumer protection, product safety, tax and other legal requirements that apply to your business.

6. Buyer responsibilities

If you contact a seller or arrange to buy an item through NOTS, you agree to:

Buyers should take reasonable care when arranging payments or collections with people they have not met before.

7. Private sellers and business sellers

NOTS may be used by both private individuals and people selling as a business.

A private seller is generally someone selling their own possessions outside the course of a business.

A business seller is someone acting for purposes relating to their trade, business, craft or profession.

Different legal rights and responsibilities can apply depending on whether a buyer purchases from a private seller or a business seller.

Sellers must not falsely describe themselves as private sellers when they are actually operating as a business.

Nothing in these terms removes or limits any consumer rights that apply under the law.

8. Listing rules and prohibited items

NOTS is intended for genuine vintage, antique, collectible, second-hand and related items.

You must not list or promote:

We may remove listings that break these rules or that we reasonably consider unsuitable for NOTS.

9. Listing descriptions and photographs

Sellers must use their own photographs or images they have permission to use.

Listing descriptions must not deliberately hide important information about an item's condition, authenticity, age, origin or defects.

Vintage and antique items may show signs of age and use. Sellers should describe these honestly and include photographs that help buyers understand the item's condition.

10. Messages and communication

NOTS provides messaging features so buyers and sellers can communicate about listings.

You must not use messages to:

We may take action where messages are reported or where we reasonably believe these rules have been broken.

11. Payments, collection and delivery

NOTS does not currently provide payment processing, delivery or collection services.

Buyers and sellers are responsible for agreeing:

Buyers should use sensible payment methods and avoid sending money where they have concerns about a seller or the item being advertised.

12. Sold, unavailable and removed listings

Sellers are responsible for keeping their listings up to date.

When an item has been sold or is no longer available, sellers should mark the listing as sold or remove it.

NOTS may remove, hide or update the visibility of listings that are misleading, inappropriate, outdated or in breach of these terms.

13. Favourites and seller profiles

Registered users may be able to save favourite listings and create a seller profile.

Any information you choose to include in your public seller profile may be visible to other website visitors.

You are responsible for ensuring that the information you publish is accurate and does not contain another person's private information without permission.

14. Moderation and account suspension

We want NOTS to remain a welcoming and trustworthy marketplace.

We may investigate reports, remove listings, restrict features or suspend accounts where we reasonably believe a user has:

Where appropriate, we may give users an opportunity to explain or resolve an issue before taking action.

We may also suspend or close accounts where required by law or where necessary to protect the website or its users.

15. Our role and responsibility

NOTS provides the online platform for users to advertise items and communicate with each other.

We do not own, inspect, authenticate, store or directly sell items advertised by users.

We cannot guarantee that:

Users should make their own checks before entering into a transaction.

Nothing in these terms excludes or limits liability where doing so would be unlawful. This includes liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any rights that cannot legally be excluded or restricted.

16. Website availability

We aim to keep NOTS available and working properly, but we cannot guarantee uninterrupted access.

We may temporarily suspend access for maintenance, updates, security reasons or technical problems.

We may change, improve or discontinue website features as NOTS develops.

17. Intellectual property

The NOTS name, branding, website design and original website content belong to NOTS or are used with permission.

You must not copy, reproduce or use NOTS branding or website content for commercial purposes without permission.

Sellers retain responsibility for the content and photographs they upload.

By uploading content, you give NOTS permission to display, store and use that content as reasonably necessary to operate and promote the marketplace.

You confirm that you have the rights needed to upload and share that content.

18. Privacy and personal information

Your use of NOTS is also subject to our Privacy Policy.

The Privacy Policy explains what information we collect, how we use it and how you can exercise your data protection rights.

19. Changes to these terms

We may update these Terms of Use when NOTS changes, when new features are introduced or when legal requirements change.

The latest version will be published on this page with an updated date.

If a change significantly affects users, we will take reasonable steps to bring it to their attention.

20. Governing law

These terms are governed by the laws of England and Wales, unless the law requires otherwise.

Any disputes will be dealt with by the courts that have jurisdiction under applicable law.
